Code of Criminal Procedure, 1973–Sec. 173(8)–Further investigation–Permission for–Scope for granting–Investigation agency had submitted the FR–During the pendency of hearing of the protest petition, it moved the application for granting the permission for further investigation and returning back the file–Allowed–Held, the order was not in consonance with the spirit of law–Quashed and set aside with the direction to issue the notice to complainant on protest petition.
