Penal Code, 1860–Sec. 376–Conviction–Justification–Complainant was not examined by doctor after the alleged incident and prosecution did not examine the doctor in the trial–Earlier, similar types of complaints were made by her which were found false–Enmity between the appellant and her husband–Sufficient evidence to show that she was habitual for implicating all the persons by making wild allegations of such nature–No eye witness of incident–One witness, cited by prosecution was a chance witness–Held, prosecution failed to prove the case beyond reasonable doubt–Appellant is entitled to be acquitted.
