Arms Act, 1959–Secs. 3/25 & 5/27–Conviction–Sustainability–While effecting two different recoveries of firearms from two different accuseds, the investigation officer associated only one witness in each case–Recoveries were effected after more than 25 days of the incident–It is not worthy to accept that the accused would preserve the country made firearms which are not too valuable so that the same could be recovered and used against them–Report of ballistic expert that the bullets recovered from the finger of deceased and place of the incident did not match with these recovered weapons–It would be unsafe to rely on the evidence of recovery–Conviction set aside.
