Specific Relief Act, 1963–Sec. 16(c)–Stipulation in the agreement that the vendor would get measured and demarcated the land within three months following which the purchaser will pay the balance sale consideration–Performance of the purchaser’s obligation to pay the balance sale consideration within three months is dependent upon the fulfillment of the vendor’s obligation to get the land measured and demarcated within three months–Otherwise, it was impossible for the purchaser to get the sale deed executed and as such the question of paying the balance sale consideration does not arise–High Court rightly decreed the suit.
