Code of Civil Procedure, 1908–Order 41, Rule 27–While deciding the application filed by respondents under Order 41, Rule 27, High Court did not notice the law laid down in the relevant decisions of this Court and proceeded to decide the application/appeals–Jurisdictional error was committed by High Court–Interim order passed on application as well as the final order are set aside and matter is remanded back for deciding afresh.
