Code of Civil Procedure, 1908–Order 41, Rule 31–Scope–While disposing the appeal, Division Bench failed to consider the relevant principle and passed a cryptic and unreasoned order–Court is required to pass a reasoned order in every case which must contain the narration of facts of the case, issue arising in the case, the submission urged by the parties, the legal principles applicable to the issues involved and the reason in support of findings–Impugned judgment of High Court set aside and matter remanded back for deciding the appeal afresh.
