Limitation Act, 1963–Sec. 5–Scope–It is not the mandate of Section 5 to file a separate application and there is no bar to exercise the powers u/s. 5 of the Limitation Act by the Court/Tribunal to condone the delay in absence of formal application–However, the Court can always insist that an application or an affidavit showing cause for delay be filed.
