Penal Code, 1860–Secs. 302, 498-A & 201–Conviction–Medical evidence clearly showing that the death was caused because of strangulation/constriction force around the neck–Deceased was not recovered in hanging position–Further, there was no immediate provocation to take the step of suicide–Classic signes of hanging were found absent–Held, conviction u/s. 498-A is liable to be set aside.
