Employee’s State Insurance Act, 1948–Sec. 45–Recovery notice–Writ petition against–Allowed by High Court with the view that the Nagar Nigam was not covered under the Act of 1948–Justification–No pleading up to effect that the respondent-Nagar Nigam ever sought for or it was granted the exemption by the Appropriate Government by exercising powers u/s. 90 of the Act–No response of notice was given by it–For the earlier period between 1964 to 1978, the regular contribution was paid–It was a fit matter to religate the matter u/s. 75(1)(g) to the Insurance Court rather than interfering in the exercise of the writ petition–Impugned order is set aside.
