Rajasthan Land Revenue Act, 1956–Sec. 89–Rajasthan Panchayati Raj Act,1994–Sec. 50–District Collector allowed the application and directed to deposit the amount of compensation–Writ petition against–Dismissed with the view that the statutory remedy of filing the appeal is available–Land is entered in the khatedari of Doli Banam Mandir Shri Mahadevji–No material on record to show that the land of temple was ever part of the mining lease granted to M–Respondent no. 5 deliberately and intentionally impleaded the Devasthan Department–No effort was made to implead the temple–Order dated 06.01.2020 by which the service was presumed to be complete, does not bear the signatures of Presiding Officer–District Collector had no jurisdiction to entertain the application–No notice was also issued to Gram Panchayat–Objection of maintainability of writ petition on account of statutory remedy would hamper the rights of Gram Panchayat and devotees–Single Bench was not justified in rejecting the writ petition–Impugned order passed by the District Collector deserves to be quashed.
