Penal Code, 1860–Sec. 376–Second FIR for the same offence–Permissibility–On earlier two occasions, the respondent no. 2 levelled the allegations of rape–After lodging the FIR, she went to cohabitate with the petitioner for a long time then again lodged the report for the allegation of rape and then joined his company persuaded this Court to quash the FIR–She was a consenting party with the petitioner for establishing physical relations–Present one is a successive FIR of the earlier incident in which she retracted from the allegations–It would amount an abuse of process of law–Quashed and set aside.
