Penal Code, 1860–Secs. 363, 366, 344, 376(2)(F)–POCSO Act, 2012–Sec.5(L)(N)/6–Conviction–Sustainability–Prosecutrix herself accompanied the accused as per her own accord and travelled with him by using the public transport–She stayed with appellant for 3.5 months as his wife–Defence gave the valid suggestion that the date of birth was stated on the lower side in the form for secondary examination–She was more than eighteen years on the day of occurrence–Appellant is entitled to be acquitted.
