Code of Civil Procedure, 1908–Order 22, Rule 4–Scope–Legal representatives of the deceased-defendant are entitled to all the defences which were available to the deceased but if they intends to make any personal or independent defence de hors the defence available to the deceased, they must get impleaded in their individual capacity or retain the rights to file independent suit asserting their own rights.
