Penal Code, 1860–Secs. 304-B, 201 & 498-A–Conviction Sustainability–Investigation Officer admitted that the efforts were made to extinguish the fire–Minor child of appellant suffered the fire injuires and household articles were also brunt–Recovery of empty tin of kerosene oil was not effected–Presence of water was found on the burnt articles–Prosecution failed to establish beyond doubt that the appellant murdered the deceased-wife–Plea taken by him u/s. 313 seems to be plausible–He is entitled to be acquitted.
