Penal Code, 1860–Secs. 380, 447 & 506 [Corresponding Secs. 305, 329(3) & 351(2), (3) of BNS, 2023]–FIR for the offence–Long on going land dispute between the parties–Revenue suit has already been filed by the complainant–Complainant himself admitted in that suit that the petitioners are in the possession of the land since the year 2005–When, he himself tried to forceably enter into the land, to resist the same, one FIR was lodged against him–Impugned FIR has been lodged by him much after the earliler FIR, lodged by the petitioners–Dispute with regard to possession can be adjudicated by the competent Court–FIR is liable to be quashed.
