Mines & Minerals (Development & Regulation) Act, 1957–Secs. 4(1)(A) & 21–Illegal mining–Recovery proceedings–Imposition of penalty–It has been reported that on account of illegal mining undertaken in QL No. 215/A, the land sliding had taken place and debaris of the land (Bara) spread in the mine and got collapsed–The house of neighbour was also cracked on account of illegal activities–Despite repeated notices and reminders, petitioners proceeded with illegal mining–Petitioners are shying away from the responsibility and liability by simply pleading that the inspection report was prepared in their absence, whereas it is discernible from the photographs that the illegal mining was conducted by them–Held, no interference is called for in the impugned order.
