Narcotic Drugs & Psychotropic Substances Act, 1985–Sec. 8/20–Conviction–Justification–FSL report was not tendered in evidence nor was put before the accused at the time of statements u/s. 313–Prosecution failed the exclusive possession of the accused over the room from where the contraband was recovered–No convincing evidence to show that the samples remained in intact condition till reaching FSL–Mandatory provisions of Sec. 42 have not complied–Conviction deserves to be set aside.
