Penal Code, 1860–Secs. 302/34–Conviction–Version of eye-witnesses–Reliability–Conviction is based on the testimony of PW 2 & PW 3–No other independent witness–It is difficult to appreciate that these witnesses would go home, take meal and go to bed without bothering about the welfare of their injured son–Their testimony cannot be accepted as the eye-witnesses of the incident even the appellants were named in the FIR–It is doubtful that the appellants alone were the authors of injuries–Conviction cannot be sustained.
