Code of Civil Procedure, 1908–Sec. 10–Scope–Even when the issue was similar and the rights were interlinked but since the basic nature of the suit was different and the petitioner was not party in earlier suit, continuance of the suit would not prejudice either of party–Impugned order deserves to be quashed and set aside–However, the respondent can seek a prayer before the trial Court for hearing of both suits together.
