Prevention of Corruption Act, 1988–Secs. 7 & 13(1)(d) r/w. 13(2)–Conviction –Recovery of Rs. 2300/- as the alleged illegal gratification through trap proceeding–However, no work was pending with the appellant-doctor on the date on which the trap proceedings were set against him–It is also not clear that for which possible purpose the complainant was called at the residence of the appellant–Appellant had already prepared the medical report and it had been already dispatched and received at the police station on the same day–Alleged demand has not been proven–Appellant is entitled to be acquitted.
