Rajasthan Land Revenue Act, 1956–Sec. 91 & 9–Order of restoration of status of land, passed by Division Bench of BOR–Appreciation of–Land in dispute was recorded for use of general public–Nothing on record to show that it was ever allotted to any individual or society–It is not clear that the application for conversion of land for residential purpose filed by society was entertained by the prescribed Authority–Further, land encroached by petitioners is much more than the converted land–Further more, petitioners were directed to be evicted in earlier proceedings u/s. 91–It is not clear that how they continued in possession–Khatedari rights can not be granted over the land embarked for use of public purpose–Held, BOR rightly exercised the powers u/s. 9 of Act–Directions issued for removal of encroachment.
