Code of Criminal Procedure, 1973–Sec. 197–Penal Code, 1860–Secs. 323 & 504–Prosecution of police personnel–Permissibility–Allegation that three persons were illegally detained in police station without any reason and only in misuse of powers–Further, the complainants were badly treated in custody–Arrest and detention of complainant-respondent was made by the police in the lawful exercise of powers u/s. 151 Cr.P.C. in order to prevent the breach of piece and tranquility in the society–This fact was clearly observed by the Judicial Magistrate that the detention was not illegal–Complainant deliberately and knowingly concealed the fact that he accepted his guilt and allegations levelled against him in the criminal complaint filed u/ss. 107/116(3) r/w. 151 Cr.P.C.–The acts done by the petitioner have been purportedly done in discharge of his duties as SHO–Injuries are simple abrasions and bruises–Prosecution of petitioner is not liable to proceed further in absence of sanction u/s. 197–Impugned order passed by the Revisional Court is liable to be quashed.
