Motor Vehicles Act, 1988–Sec. 147–Passengers in goods vehicle–Truck in question was found loaded with broom leaves (Khajur Leaves)–Statements of witnesses u/s. 161 Cr.P.C. and before the Tribunal showing that the claimants were actually the owners of broom leaves and they were going to Ahmedabad for selling them collectively–Quite possible that they were going for selling the broom leaves to earn their livelihood–All were from the same family, therefore, it is possible that they collected the broom leaves and hired the truck collectively–It cannot be segregated that there was only one owner and other persons who boarded the truck were not the owners of goods–Liability was rightly fastened on Insurance Company.
