Bharatiya Nyaya Sanhita, 2023–Sec. 482 [Corresponding Sec. 438 of Cr.P.C., 1973]–Prevention of Corruption Act, 1988–Parameters for grant of anticipatory bail in a serious offence like corruption–Anticipatory bail can be granted only in exceptional circumstances where the Court is prima facie of view that the applicant has been made falsely enroped in the crime or the allegations are politically motivated or are frivolous–It cannot be said that any exceptional circumstance has been made out by the petitioner–High Court rightly denied the anticipatory bail –However, if the petitioner prays for regular bail, the same shall be considered on its merits.
