Code of Criminal Procedure, 1973–Secs. 173(8) & 482–Direction of further investigation by High Court–Allegations of defalcation of goods and misappropriation of stock from the godown–Imputations were made only against the respondent no. 3 who was a class IV employee–Informant omitted to state the several relevant facts while lodging the FIR–Investigation Officer also overlooked them while submitting the charge-sheet–Held, High Court was justified in ordering for further investigation particularly qua the role of appellant–However, certain harsh and severe expressions made by High Court Devendra Nath Singh vs. State of Bihar would cause the prejudice to appellant–These were not justified.
