Code of Civil Procedure, 1908–Order 6, Rule 17–Application under–Rejection of–Suit for injunction was preferred by the plaintiff that the land in question was a govt. land and the patta qua the land could not have been issued–Suit has been decided against the petitioner only on the ground of land in question being gochar land–Petitioner filed a writ petition before this Court which was decided in his favour after the decision of suit–Judgment passed by this Court is required to be taken on record–Matter is remanded back to Appellate Court to pass an appropriate order on the application under Order 6, Rule 17.
