Forest Act, 1927–Secs. 41 & 42–FIR for the offence–Sustainability–Sections 41 & 42 of the Act provide a maximum punishment of six months imprisonment–As per Part II of the First Schedule of Cr.P.C., an offence punishable with imprisonment for less than three years is deemed to be non-cognizable and bailable unless specifically stated otherwise in the enactment –Alleged offences are bailable and non-cognizable–Respondent-Authorities could not have been proceeded with the investigation without obtaining prior sanction from the competent Magistrate–Petition deserves to be disposed of accordingly.
