Jaipur Development Authority Act, 1982–Secs. 74, 31(1) & 37(2)–Cognizance for the offence–Sustainability–Petitioner was impleaded in the instant case as if he was the Director of the Company on the date of commission of the offence–Enforcement Officer of JDA has not investigated upon the factual aspect laid by the petitioner that he had already resigned as the Director w.e.f. 16.08.2001–He produced the Form No. 32 submitted before the Registrar of Companies–There is sufficient material on record to show that he was not a Director on 04.08.2014 when the offence was alleged to have been committed–Impunged order is liable to be quashed and set aside–Petitioner stands discharged of all the charges.
