Act by the petitioner –Respondent admitted his signatures over the cheque–Held, petitioner cannot be prosecuted for bald allegations–Further, respondent no. 2 acted in violation of the mandates of the Income Tax Act and he cannot be allowed to get the protection of his unlawful act–FIR and subsequent proceedings quashed.
