Penal Code, 1860–Secs. 304-A, 337 & 279–Conviction–Sustainability–Identification parade was conducted after one year of the incident–Occurrence took place at night and lights of both vehicles were broken in the incident–There was no source of light and it is improbable that the driver of the erring vehicle could be identified–Evidence of eye-witnesses is not reliable–Held, it would not be safe to convict the petitioner.
