Penal Code, 1860–Secs. 302/34–Conviction–Appreciation of–Testimony of eye-witnesses is sufficient to conclude that the appellants assaulted the two deceased persons by sharp weapons–They admitted the fact of incident and stated that they acted in right of private defence–No evidence was submitted to show that the land was in their exclusive cultivatory possession–Incident took at numerous places–Eye witness A cannot be held unreliable merely because she did not intervene to save the deceased–Appellants caused the murder of their own kith and kin–They launched a brutal pre-meditated assault with sharp weapons on the deceased who were totally unarmed–A large number of injuries were caused–Held, they were rightly held guilty for the offence u/s. 302/34.
