Stamp Act, 1899–Sec. 39–Registration Act, 1908–Sec. 17–Document Ex-A-1 cannot be termed as the deed of partition–Therefore, it does not require essential registration u/s. 17 and can be admitted in evidence–However, it suffers from the deficiency of stamp duty–DIrected to impound the document for determination of proper stamp duty and penalty.
