Hindu Undivided Family–Alienation of the property by the Karta of family for the legal necessity fo family–Claim of plaintiff that the defendant no. 1 assured him that the money derived from such sale would be settled and no other properties would be sold–Plaintiff has not taken any step for recovery of such outstanding dues earlier or even in the present case–Sale deed was executed prior to one year of marriage of K–Money receipts for the sale consideration were signed by two coparceners and wife and daughter “K” of first defendant–The fifth defendant-purchaser has established a clear nexus between the sale transaction and the expenses undertaken for the marriage of “K”–Conduct of plaintiff belatedly challenging the sale transaction raises a grave doubt over his bona fides–Explanation as regard to delay is found facetious–Trial Court rightly dismissed the suit–Impugned judgment and decree passed by the High Court are liable to be set aside.
