Registration Act, 1908–Secs. 47, 23 & 74–Sale deed was presented before the Registrar on 11.01.2019 for registration and the necessary e-challan, appropriate stamp duty, affidavits, and prescribed forms were deposited–On the same day, the consideration was paid and the possession was given to the petitioner–Sale deed could not be registered due to the server being down and next three days were public holidays–Final registration was carried on 15.01.2019–As per Sec. 47, a registration shall operate from the time which it would have commenced to operate if no registration thereof has been required or made, and not from the time of its registration–It cannot be said that there was a non-registration of documents on or before 12.01.2019.
