Code of Civil Procedure, 1908–Sec. 96–Permanent Injunction–Civil Jurisprudence–While reversing the decree of permanent injunction, first appellate Court recorded the additional findings that the wall in question shall remain joint and common between both parties and the defendants are permitted to put load/roof of their building using the common wall–Findings were unwarranted and beyond the scope of prayer of plaint–Same are without jurisdiction and deserve to be set aside.
