Rajasthan Tenancy Act, 1955–Secs. 42 & 88–Decree of declaration –Set aside by RAA by condoning the delay of 35 years–BOR reversed the findings of RAA–Appreciation of–Suit was not only decreed on the basis of compromise but also the plaintiff abled to establish his possession since the year 1953–Provisions of Sec. 42 came in effect w.e.f. 24.03.1955, whereas the possession had already been given in the year 1953–Delay was also wrongly condoned by RAA–Held, no legal error or perversity is found in the impugned order passed by BOR.
