Specific Relief Act, 1963–Sec. 12–Suit for specific performance of sale agreement–Dismissed by High Court with the direction to return the earnest money–Justification–Respondent no. 3 executed the release deed in favour of respondent no. 4 after the plaintiff had filed the suit for permanent injunction in regard to suit property–Execution of release deed by respondent no. 3 and sale deed by respondent no. 4 were hit by the principle of lis pendens, looking at the peculiar facts of the present case–Respondent nos. 1 & 2 cannot claim that they are bonafide purchasers of the property because they were aware of the injunction order–Sale deed executed in their favour was without any legal sanctity–Decree passed by Trial Court deserves to be upheld.
