Narcotic Drugs & Psychotropic Substances Act, 1985–Secs. 8/18(b), 8/15(c) & 8/29–Acquittal–Appreciation of–Recovery of 249.5 kgs poppy straw powder–Independent witnesses associated with recovery, did not support the case of prosecution–Other occupants were also present in the house form where the recovery was effected–Further, prosecution failed to establish that the samples remained intact till reaching FSL–Trial Court also acted in casual fashion while concluding the proceedings–Prosecution failed to show the compliance of provisions of Sec. 42(2)–Public Prosecutor also indulged in negligence for trying to get the accused acquitted–No interference is required in the findings of acquittal.
