Code of Criminal Procedure, 1973–Sec. 167(2)–Order of default bail–Effect on the investigation–Accused was given the police custody of seven days–After arrest, he got himself hospitalized–Thereafter, he was granted interim bail–CBI could not interrogate him during the police custody and, thereafter, he did not cooperate the investigation agency during the interim bail–Special Court cancelled the interim bail–Thereafter, the High Court allowed the default bail on the ground of lapse of the period of 90 days–Order of seven days police custody attained finality, however, CBI could not interrogate the accused in police custody for above reasons–Held, CBI is permitted to have the police custody of four days.
