Negotiable Instruments Act, 1881–Sec. 138–Dishonour of cheque–Conviction–Set aside by High Court–Justification–Cheques in question were given subsequent to notice not to clear the earlier cheques–No explanation as to why the subsequent cheques could not have been cleared–It is for the accused to explain his case and defend it, once the fact of cheque bouncing is prima facie established–Burden to disprove the allegation is on him–Impugned order of High Court deserves to be set aside.
