Rajasthan Minor Minerals (Concession) Rules, 2017–Rule 11(1), 31(4) & 45(7)–Imposition of penalty–Petitioner has excavated minerals in excess i.e., beyond the limit prescribed under EC issued by the competent authority–He has been served upon umpteen number of notices by the respondent no. 3, therefore, it cannot be said that he was not given the opportunity–Crusher reject is having 60% CaCo3 and these mining rejects are utilized by the petitioner in cement manufacturing–Therefore, the contention that the mining reject is of no use, cannot be accepted–Held, respondents were justified in imposing the penalty.
