Penal Code, 1860–Secs. 304 Pt. I & II–Applicability of both provisions–Held, if there is only knowledge that the death will be occurred by the act, Pt. II of Sec. 304 will be applicable and where the intention and knowledge both have existed Pt. I will be applicable.
