Code of Criminal Procedure, 1973–Sec. 161–Statements of prosecution witness–Whether contradicted or not ?–PW 2 was an injured witness and she was the wife of the deceased–Her presence at the spot of the incident is quite natural–In the examination in chief, she gave the detail of the incident and precise role assigned to each of assailants–Some discrepancies invariably occur in the testimony when the witness is a woman and resides in a village–Neither the incident nor the offenders are in doubt–Incident resulted into one death and grievous injuries to another–High Court went wrong in discrediting the testimony of PW 2.
