Penal Code, 1860–Secs. 325/109–Conviction–Reduction of the sentence–While altering the conviction u/s. 308, High Court granted the benefit of probation to three co-accuseds by considering their old age varying between 85 to 75 years–Appellants cannot claim on the ground of parity–However, in view of fact that the offence was committed for a drain, sentence reduced up to the period of three years.
