Drugs & Cosmetics Act, 1940–Sec. 32 r/w. 36-A–Scope–Only the Special Court is competent to take the cognizance for the offence–All the District & Sessions Courts of Rajasthan are authorized by the notification dated 18.02.2011–In the instant case, the charges were framed by the Upper Session Judge who was not having the jurisdiction to try the case–Order of framing of charge it vitiated–Set aside and matter remanded back for proceedings afresh.
