Rajasthan Municipalities Act, 2009–Construction permission–Appeal against–Allowed–Justification–Earlier, the petitioner was granted construction permission in the year 1986–Thereafter, an attempt was made to demolish his construction but he filed a civil suit which was decreed in his favour–Decree has attained finality–Now, in the instant construction permission, findings recorded by the Appellate Authority are contrary to the decree passed in the civil suit –Impugned order passed in appeal and revision set aside and matter remanded back to decide the appeal in accordance with law.
