Transfer of Property Act, 1882–Sec. 52–Code of Civil Procedure, 1908–Sec. 144–Respondent no. 3 (third party) purchased the property from the decree-holder-cum auction purchaser on 17.07.2009 with full knowledge of pending restitution proceedings as the same is contained in the recital in para no. 4 of the sale deed–Held, he is not entitled to object to the restitution on the ground that he is a bonafide purchaser.
