Rajasthan Panchayati Raj Act, 1994–Sec. 39–Petitioner was suspended and, thereafter, he was re-instated after an interim order passed by this Court–After lapse of one year and two months, he has been again suspended relying upon the earlier inspection report (report dated 10-08-2021)–Ground of respondents that there is one more inquiry report and it has been placed on the record–But interestingly, that report has not been taken note of while passing the impugned suspension order–The chronology of the events in the present case clearly demonstrates that the respondents are bent upon keeping the petitioner away from working as Sarpanch for a reason or other –Impugned order is liable to be quashed and set aside.
