Code of Criminal Procedure, 1973–Sec. 452(2)–Amount of Rs. 10.52 lac was directed to be returned to Devasthan Vibhag–Petitioner–accused claiming the supurdgi–Offence u/s. 395–Though the petitioners have been acquitted on the ground of benefit of the doubt yet it is not a ground to return the seized articles to them–Order can be passed after proper inquiry–Petitioners ought to make first claim when they were produced before the Magistrate for the first time or at any other subsequent stage–Held, no interference is required in the impugned order of Court below.
