Penal Code, 1860–Secs. 302, 365 & 201–Murder of wife–Conviction–Circumstantial evidence–Deceased used to come to village Chainiya on every Saturday–Appellant failed to explain the circumstance under which the child came in his possession–He also failed to explain how the child and his mother were separated to each other–He did not report for a long absence of his wife–The evidence reveals that he had relations with the co-accused K which was the reason of dispute between the appellant and deceased–
Injuries sustained by the deceased were antemortem–No reason to believe that anybody else had caused the death of deceased–Held, the conviction was justified.
